Orange County Estate Planning

Planning for Tomorrow for Peace of Mind Today

In the past an Estate Plan may have consisted of a mere will. However, the complex nature of California law, the expense and publicity of Probating a Will, and potential for incapacity has led to the need for more advanced techniques to dispose of and manage your personal property, real estate, finances, and family business.  Modern Estate Planning in Orange County will typically include planning for the disposition of property at death outside the Probate process through the use of a Pour-Over Will and Revocable Living Trust. A Durable Power of Attorney (DPOA) provides for management of your property during incapacity in the hands of a person of trust and avoids the more complicated Conservatorship court procedures. Finally, an Advanced Healthcare Directive (AHCD), also known as a Living Will, ensures your preferences for health care decisions are followed in the event of your incapacity.  Although the content of each Estate Plan is personally crafted for each client’s unique needs and desires a comprehensive plan by me will include:

  • Pour-over Will
  • Revocable Living Trust
    • Funding of the Trust (an extra charge at many other firms)
    • Instructions on Maintaining and adding to Trust
  • AHCD
  • DPOA
  • Instructions in Case of Death or Incapacity

Advanced Estate Planning

I recognize that an Estate Plan highly personal and that one size fits all solutions are not always appropriate. For larger estates the tax burden upon death can be great. As an Orange County California Estate Planning Attorney I employ numerous strategies to reduce your taxable estate resulting in substantial tax savings. Included in these strategies are Married Deduction Planning; Qualified Domestic Trusts (QDOT), Irrevocable Life Insurance Trust (ILIT), Family Limited Partnership (FLP). In addition, I will assist in creating your family legacy through charitable giving or a private foundation in your name.

Many families also care for loved ones with special needs, I can help you create a special needs trust to ensure the care your loved one deserves lasts well into the future.
